All trustees must be:

  • Over 18
  • Not disqualified by law from being a charity trustee

Requirements of the work

  • Liaise with trustees, ask advice, debate and follow direction
  • Provide trustees with accurate information to make management decisions
  • Attend monthly meetings

Important information for trustees of all companies:

RISK exists where there is:

  • Breach of their fiduciary and statutory duties as trustees, for example:
    • Using the charitable company's assets to procure a benefit for the trustees
    • Making a loan to a trustee
  • Wrongful trading under the Insolvency Act 1986: continuing to trade when you know, or ought to have known, that there was no reasonable prospect of avoiding insolvent liquidation.
  • Fraudulent trading: actual dishonesty in the running of the charity, such as incurring a debt where the trustees know there is little prospect of ever repaying it.
  • Acting as a company trustee when disqualified.
  • Breaking trust
